Terms of Service - PithToken

1. Service Overview

PithToken provides a Software-as-a-Service (SaaS) API proxy service that optimizes prompts before forwarding them to language model providers. Users access PithToken exclusively through our API interface using authentication tokens.

Our service integrates with third-party providers including OpenAI, Anthropic, and OpenRouter. The optimization process modifies prompt text to enhance clarity, efficiency, and response quality before transmission to your chosen provider.

2. User Responsibilities

You are fully responsible for:

The content and accuracy of all prompts transmitted through PithToken
Compliance with applicable laws and regulations in your jurisdiction
Ensuring your prompts do not violate the terms of your provider agreements or contain illegal content
Protecting the confidentiality of your API keys and authentication credentials
Any content generated by language model providers using your prompts

PithToken is not responsible for outputs generated by external providers or consequences arising from your use of those outputs.

3. API Key Management

When you use PithToken, you must provide API keys for your chosen language model provider (OpenAI, Anthropic, or OpenRouter). These keys are stored using encryption standards appropriate for sensitive credentials.

                Important: You retain complete ownership of your API keys. PithToken does not store, use, or share your keys for any purpose other than proxying your authorized requests. Never share your PithToken API key with untrusted parties.
            

4. Prompt Optimization

PithToken's core function is to optimize prompts before they reach language model providers. Our optimization process:

Modifies prompt text to enhance clarity and potentially improve response quality
May adjust phrasing, structure, or emphasis while preserving your intent
Operates transparently—you can review optimized prompts in your API responses

No Guarantees: PithToken makes no guarantee regarding optimization quality, cost savings percentage, response quality improvements, or any other outcome. Optimization results vary based on prompt content, model selection, and other factors beyond our control.

5. Pricing and Tiers

PithToken offers a Free tier and a Pro tier with different rate limits and features. Pricing terms are set forth in your account settings and may be updated with 30 days' notice.

You are responsible for monitoring your usage and understanding billing implications. Unpaid invoices may result in service suspension.

6. Data Handling and Analytics

Prompt Content: Prompts are NOT stored or retained by PithToken after processing. Your prompt text passes through our service to your chosen provider but is not archived, logged, or analyzed for secondary purposes.

Metadata Logging: We may log the following for analytics, service improvement, and abuse prevention:

Request timestamps
Token counts and usage metrics
Model selected and provider used
Latency measurements
Estimated cost savings percentages

These logs do not include the actual prompt or completion text.

7. Service Availability and Modifications

PithToken is provided "as is" without any warranty, express or implied. We do not guarantee uninterrupted service availability, specific uptime percentages, or error-free operation.

PithToken reserves the right to:

Modify, enhance, or change the optimization algorithms without notice
Update API endpoints, parameters, or response formats
Suspend or discontinue features
Make improvements to the service at any time

Material changes to core functionality will be communicated in advance where commercially feasible.

8. Prohibited Use

You agree not to:

Reverse engineer, decompile, or attempt to extract PithToken's optimization algorithms
Use the service to build, train, or improve competing prompt optimization products
Share your API key or allow unauthorized access to your account
Transmit malware, spam, or content intended to disrupt PithToken's infrastructure
Exceed documented rate limits or engage in resource hoarding
Violate any applicable laws or third-party rights through your use of the service

Violation of these terms may result in immediate account suspension or termination.

9. Account Termination

PithToken may suspend or terminate your account at any time, with or without cause, if we determine that:

Your account has been inactive for an extended period
You have violated these Terms of Service
Your use constitutes abuse or violates applicable law
We determine it necessary for operational or legal reasons

Upon termination, your access to the service ceases immediately. Unused credits or prepaid amounts may not be refunded, except as required by applicable law.

10. Limitation of Liability

To the maximum extent permitted by law, PithToken and its directors, officers, and employees are not liable for:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, or business interruption
Damages arising from external provider failures or API changes
Content or outputs generated by third-party language model providers

Our total liability is limited to the amount you have paid to PithToken in the 12 months preceding the claim.

11. Intellectual Property

PithToken retains all intellectual property rights to:

Our optimization algorithms and methodologies
The PithToken platform, code, and service infrastructure
Documentation, analytics, and derivative insights

You retain ownership of your original prompt content. You grant PithToken a limited license to process and transmit your prompts as necessary to provide the service.

12. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

You irrevocably submit to the exclusive jurisdiction of the English courts for any disputes arising from or relating to this agreement or your use of PithToken.

13. Changes to These Terms

PithToken reserves the right to modify these Terms at any time. Material changes will be communicated via email or through the service dashboard. Continued use following notification constitutes acceptance of modified terms.
